Privacy Policy

1. Introduction

1.1 General. Maker Hub respects its Users’ privacy. This Privacy Policy explains (i) what information Maker Hub collects through the Users’ access and use of the website accessible without limitation which is a digital knowledhe platform platform, and allows anyone with a single touchpoint to get an overview of digital tools on the market and to receive personalized assistance for a digital project application, and optionally the Maker Hub All-in-one full service for buying, selling and promoting didital tools and products(the Platform), and any other products and/or services available at the same URL address (together the Services), which are provided by Maker Hub; (ii) the use Maker Hub makes of such information; and (iii) the security level Maker Hub provides for protecting such information.1.2 Definitions. All other capitalized terms not defined this Privacy Policy shall have the meaning set forth in the Terms of Use accessible at https://www.makerhub.app/footer/terms-and-conditions1.3 Acceptance. By accessing and/or using the Services, the Users agree to the terms and conditions of this Privacy Policy. and are aware that Maker Hub’s policies may change in the future to adapt to future practices, technology or modification in the law.

2. Collected information

2.1 Specific data collected. When Users access and use the Services, Maker Hub collects the specific following personal data and information: (i) Full name; (ii) company name, if applicable; (iii) email address; (iv) zip code; (v) phone number; (vi) IP address; (vi) visiting date on the Platform; (viii) research criteria of tools; (ix) list of the tools and products viewed on the Platform; (x) Users’ interaction with the Services such as their navigation details on the Platform, notably without limitation information about Users’ Web browser, webpages Users visited and saved, and log files; and (xi) data collected from third-party plugins/websites such as without limitation Facebook, Google, Euro Tax, that are provided when Users submit their personal data through the Services.In order to process a submit application, a private customer will need to provide the Maker Hub with all details and information necessary for such an application. This includes, but may not be limited to, the following:

Birth date
Nationality
Job role
Employer
E-mail
Name of the product, tool, digital product etc.

2.2 Means of collection. Maker Hub collects the Users’ personal data when they access and use the Services, in particular: when Users access and navigate through the Platform; when Users willingly and voluntarily submit personal data through web forms; when Customers submit a product, tool, digital solition etc.

3. Use of collected information

3.1 Required data for performance of Services. The personal data listed in Section 2.1 (i) to (v), and (viii), are strictly necessary for Maker Hub core Services, to digitalize and comparison of tools and products as well as providing Customers a full overview of real offers on the market and enabling Customers to apply for a leasing online. Users can withdraw at any time theirs consent for such specific data processing. Please note however that such data processing is strictly necessary to provide the Users the Services and that a withdrawal may lead to the drawback that Maker Hub would not be able to provide and perform properly the Services any more. In such case, Maker Hub may terminate the Users’ access and/or use to all or part of the Services without incurring any liability whatsoever.3.2 Additional purposes of use. In addition, Maker Hub collects the personal data listed in Section 2.1 for the following specific purposes:
(i) to provide Users email alerts on latest products, tools listed on the platform; (ii) Users’ subscription to Maker Hub's newsletter, to provide them further news and updates such as product matching their interest; (iii) to provide Users with targeted marketing and advertising tailored to their preferences; (iv) to offer Users similar Services; (v) to re-engage Users accessing and using the Services; (vi) to improve the Services; (vii) for cybersecurity of the Services; and (viii) for statistical and planning purposes.Users can withdraw at any time their consent for the such specific data processing listed in this Section 3.2. In addition, Users have the rights set forth in Section 10 of this Privacy Policy.

4. Third party websites

4.1 Third party websites. The Services may contain links to other websites such as Facebook, Google, Twitter and all other social media platforms. Please note that this Privacy Policy does not apply to the practices of any company or individual that Maker Hub does not control, nor to any websites that may be linked from the Services. Users should carefully review the privacy policies of any websites that they visit from the Services to learn more about their information and privacy practices. The collection and use of the Users’ personal information shall be governed by such other party or website’s privacy policy. Maker Hub shall not be held responsible for their privacy practices.

5. Communication to third parties

5.1 Third Parties. Maker Hub may in some limited instances communicate the Users’ personal data to specific third parties, on a strict need-to-know basis, to achieve the purposes described in this Privacy Policy:
(i) Maker Hub's personnel; (ii) Sellers, with respect to the Customers and vice versa; (iii) Maker Hub  service providers such as the companies listed under Section 4, in particular for targeted marketing and advertising; (iv) competent courts or supervisory or regulatory bodies, when Maker Hub shall compellingly disclose User’s personal data, pursuant to any applicable law, regulation or order, e.g. in case of merger, sale or acquisition, or in case of bankruptcy and liquidation, if applicable; (v) Maker Hub’s IT systems providers, cloud service providers, database providers and consultants; (vi) business partners with whom Maker Hub conducts business with, which is necessary to offer the Services jointly with Maker Hub; (vii) any third party to whom Maker Hub assigns or transfers any of Maker Hub’s rights or obligations; (viii) tools providers to process an application; and (ix) companies directly related to the Maker Hub All in one product in terms of digital services, product guarantee.

6. International transfer

6.1 International transfer. Users’ personal data may be transferred to and maintained on computers located outside of their state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in their jurisdiction. In submitting such personal data, Users specifically agree to that transfer.

7. Cookies and analytics tools

7.1 How to block cookies. Maker Hub also uses “cookies” or other analytics tools to collect information. A cookie is a small data file that Maker Hub  transfers to the Users’ electronic device and is stored on their electronic device. e.g. Maker Hub uses cookies or other analytics tools to measure the traffic to and usage of the Services and their different features, and other miscellaneous uses. Maker Hub’s Cookies Policy is set forth below.7.2 Settings configuration. If Users do not wish to have cookies placed on their electronic device, Users should set their browser or electronic device to refuse cookies before using the Services, with the drawback that certain features of the Services may not function properly without the help of cookies.

8. Privacy Policy changes

8.1 Changes. Any future modifications or amendment to this Privacy Policy and/or to the processing of Users’ personal data, as described in this Privacy Policy, will be notified to Users in advance through an individual notice through Maker Hub’s usual communication channels (e.g. by email or communication within their Account) as well as through the Platform (via banners, pop-ups or other notification mechanisms).

9. Security

9.1 General. Maker Hub always strive to ensure security, integrity and privacy of the Users’ personal data.9.2 Technical and organizational measures. Maker Hub has adopted and implemented technical and organizational measures to avoid unauthorized access or disclosure of any personal data.

10. Users’ rights

10.1 Users’ rights. Users may exercise the following rights under the conditions and within the limits set forth under applicable law:the right to access their personal data as processed by Maker Hub and, if Users believe that any information relating to them is incorrect, obsolete or incomplete, to request its correction or update; the right to request the erasure of their personal data or the restriction thereof to specific categories of processing; the right to object to a channel of communication used for direct marketing purposes; the right (i) to be informed about any decision making, based the fully automated processing of their personal data, (ii) to express their view on such decision and (iii) to require that it be verified by a human being, except if (a) such decision is directly related to the conclusion of an agreement between Maker Hub and their request is accepted or (b) if they have given their express consent to such automated decision making; and the right to request their personal data’s portability, i.e. that the personal data Users have provided to Maker Hub be returned to the concerned User or transferred to the person of their choice, in a structured, commonly used and machine-readable format without hinderance from Maker Hub and subject to their confidentiality obligations.

11. Applicable law and jurisdiction

11.1 Governing Law. This Privacy Policy shall be governed by and construed in accordance with Swiss substantive law, without reference to its conflict of laws provisions.11.2 Jurisdiction. Any dispute or difference arising out of or in relation to this Privacy Policy shall be subject to the exclusive jurisdiction of the courts of Zürich, Switzerland, subject to the right of appeal to the Swiss Federal Tribunal.

Cookie Policy

1. Type of cookies used
1.1 General. Maker Hub uses several types of cookies. Some are essential, while others Users can opt out of or block. Opting out or blocking some cookies may affect the functionality of the Services. The below explanations shall help Users to make informed choices about the information they provide to Maker Hub when Users access and use the Services, in particular when they visit the Platform.

2. Why and how Maker Hub  uses cookies

2.1 Purposes of use of cookies. 5.1 Type of functionality cookies. Some cookies enable websites to remember choices persons make, for example, user name, and language or text size. These cookies are known as "functionality cookies" and help to improve a person's experience of a website by providing a more personalized service.

6. Performance cookies

6.1 Type of performance cookies. Maker Hub uses a number of tools that monitor Users’ use of the Services to help Maker Hub improve and customizes the provided information and/or services. In particular the Platform uses the Cookie Google Analytics which collects information and reports website usage statistics without personally identifying individual visitors to Google. Users can opt out of providing Maker Hub with this information if they wish, with no impact on their experience of the Platform. 7. Third Parties

7.1 Third Parties. The Services use third party services or software. Many of these services may set cookies on Users’ electronic device.7.2 Settings.
